AI-Generated Content Terms and Copyright Disclaimer

1. Scope of This Addendum

This addendum applies to all content generated, in whole or in part, through artificial intelligence ("AI") tools, features, or integrations available on or through P3H.com (the "Platform"), including but not limited to AI-generated text, images, graphics, code, layouts, and design elements.

2. Understanding AI-Generated Content and Copyright

2.1 No Copyright Protection for AI-Generated Content

Under current United States copyright law, content generated solely by artificial intelligence is not eligible for copyright protection. The U.S. Copyright Office and federal courts have consistently held that copyright requires human authorship. When you use AI features on the Platform to generate content through prompts, instructions, or similar inputs, the resulting output is generally not copyrightable because:

• The AI system, not the human user, determines how ideas are expressed
• Prompts and instructions convey ideas, but copyright protects expression, not ideas
• Users do not exercise sufficient creative control over how AI interprets and executes instructions

2.2 Iterative Prompting Does Not Establish Copyright

Repeatedly revising prompts, regenerating outputs, or selecting from multiple AI-generated options does not establish copyright ownership. Such activities constitute selection among AI-generated alternatives rather than human authorship of the underlying expression.

2.3 AI-Assisted Modifications

Instructing AI to modify existing AI-generated content (such as removing elements, changing colors, adjusting composition, or altering settings) typically does not create copyrightable authorship. While you direct what changes to make, the AI determines how to execute those changes, and it is the execution—the expression—that copyright protects.

3. Practical Implications for Users

3.1 Public Domain Status

AI-generated content created through the Platform that lacks sufficient human authorship is effectively in the public domain. This means:

• You cannot prevent others from copying, using, or distributing such content
• You cannot pursue legal claims for copyright infringement against third parties who use such content
• Others may use identical or substantially similar AI-generated content without your permission

3.2 No Exclusive Rights

You acknowledge that AI-generated content does not confer exclusive rights. Other users of the Platform, other AI services, or the public may independently generate identical or substantially similar content.

3.3 Third-Party Use

P3H does not and cannot guarantee that AI-generated content will be unique to you or unavailable to others. You should not rely on AI-generated content for purposes requiring exclusive ownership or proprietary protection.

4. Third-Party Intellectual Property

4.1 AI Training Data

AI systems used by the Platform may have been trained on content created by third parties. P3H makes no representations or warranties regarding:

• The sources of AI training data
• Whether AI-generated output may resemble or incorporate elements of third-party works
• The intellectual property status of any AI-generated content
• Whether AI-generated content infringes any third-party rights

4.2 Your Responsibility

You are solely responsible for ensuring that your use of AI-generated content does not infringe the copyrights, trademarks, or other intellectual property rights of any third party. P3H has no obligation to screen, review, or verify AI-generated content for potential infringement.

5. User Acknowledgments and Responsibilities

5.1 Acknowledgment

By using AI features on the Platform, you acknowledge and agree that:

• You have read and understand this addendum
• AI-generated content is generally not copyrightable under U.S. law
• P3H makes no representations regarding copyright ownership, originality, or exclusivity of AI-generated content
• You will not misrepresent AI-generated content as your exclusive copyrighted work
• You are solely responsible for determining the legal status of any content you use

5.2 Legal Compliance

You are solely responsible for complying with all applicable laws, regulations, and legal requirements related to your use of AI-generated content, including but not limited to copyright registration, disclosure obligations, and intellectual property laws in your jurisdiction. P3H provides no guidance on legal compliance matters.

5.3 No Reliance

You agree not to rely on AI-generated content, or any information in this addendum, for any purpose that requires copyright protection, exclusive ownership, proprietary rights, or legal certainty. You should consult qualified legal counsel for any such matters.

6. Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF AI FEATURES ON THE PLATFORM IS AT YOUR SOLE RISK. YOU ASSUME ALL RISKS ASSOCIATED WITH THE USE OF AI-GENERATED CONTENT, INCLUDING BUT NOT LIMITED TO:

• Lack of copyright protection or exclusive rights
• Potential similarity to content generated for other users
• Potential infringement of third-party intellectual property rights
• Inaccuracies, errors, or inappropriate content in AI outputs
• Changes in law affecting the status of AI-generated content
• Any commercial losses arising from reliance on AI-generated content

7. Disclaimer of Warranties

P3H PROVIDES AI FEATURES AND AI-GENERATED CONTENT "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. P3H SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, P3H MAKES NO WARRANTY THAT AI-GENERATED CONTENT WILL BE: (A) COPYRIGHTABLE OR PROTECTABLE; (B) ORIGINAL OR UNIQUE; (C) FREE FROM THIRD-PARTY INTELLECTUAL PROPERTY CLAIMS; (D) ACCURATE, COMPLETE, OR RELIABLE; (E) SUITABLE FOR ANY PARTICULAR PURPOSE; OR (F) AVAILABLE WITHOUT INTERRUPTION.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL P3H, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF AI FEATURES OR AI-GENERATED CONTENT.

P3H'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO AI FEATURES OR AI-GENERATED CONTENT SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO P3H IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100).

9. Release of Claims

To the fullest extent permitted by applicable law, you hereby release and forever discharge P3H, its affiliates, officers, directors, employees, agents, successors, and assigns from any and all claims, demands, damages, losses, costs, expenses, and liabilities of any kind, whether known or unknown, arising out of or relating to:

• The copyright status or lack thereof of AI-generated content
• Third-party claims regarding AI-generated content
• Your use of or reliance on AI-generated content
• Any representations you make about AI-generated content
• Any regulatory or legal proceedings related to AI-generated content

If you are a California resident, you waive California Civil Code Section 1542, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

10. Indemnification

You agree to indemnify, defend, and hold harmless P3H, its affiliates, officers, directors, employees, agents, suppliers, licensors, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

• Your use of AI features or AI-generated content
• Your misrepresentation of ownership or rights in AI-generated content
• Your reliance on AI-generated content for any purpose
• Any third-party claims related to your use of AI-generated content
• Your violation of any third-party intellectual property rights
• Your breach of this addendum or the Terms of Service
• Any content you create, publish, or distribute using the Platform

This indemnification obligation shall survive the termination of your account and your use of the Platform.

11. Dispute Resolution

Any dispute arising out of or relating to this addendum or AI-generated content shall be resolved in accordance with the dispute resolution provisions in the P3H Terms of Service, including the binding arbitration agreement and class action waiver contained therein.

BY USING AI FEATURES ON THE PLATFORM, YOU AGREE TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION AND WAIVE YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION.

12. Changes to This Addendum

Copyright law regarding AI-generated content is evolving. This addendum reflects P3H's understanding of current law as of the date above and does not constitute legal advice. P3H reserves the right to update this addendum at any time without prior notice. Your continued use of AI features following any updates constitutes acceptance of the revised terms.

13. Governing Law and Severability

This addendum is governed by the laws of the State of Texas, without regard to its conflict of law provisions. If any provision of this addendum is found unenforceable, the remaining provisions continue in full force and effect, and the unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
